1. Terms of Payment
A deposit payment of
40% of the total order value must be paid immediately upon acceptance of this order confirmation, unless a separate written agreement has been made.
Upon acceptance of the buyer’s order, any deposit paid is
non-refundable.
The final balance must be paid before the plant or equipment leaves the manufacturer’s premises, or the supplier’s premises if stocked in Australia.
Equipment will not be released for shipment until payment has been received in full by Acacia Bakery Solutions, unless otherwise agreed in writing.
2. Returns Policy
Goods returned for any reason will incur a
25% restocking fee, plus the cost of return freight.
All returns are subject to inspection and approval in accordance with our Returns and Exchange Policy.

3. Retention of Title
Ownership of goods remains with Acacia Bakery Solutions until full payment has been received in cleared funds for all goods supplied, including any applicable interest or charges.
Until ownership passes to the buyer:
- The buyer must hold the goods as fiduciary bailee for Acacia Bakery Solutions.
- The buyer must store the goods separately, clearly identifying them as the property of Acacia Bakery Solutions.
- The buyer must not pledge, charge, or encumber the goods in any way.
If the buyer sells the goods before ownership passes:
- The buyer must hold the proceeds of sale on trust for Acacia Bakery Solutions.
- Such proceeds must be kept in a separate account and not mixed with other funds.
In the event of default in payment or any indication of insolvency, Acacia Bakery Solutions reserves the right to enter the buyer’s premises (or any premises under the buyer’s control where the goods are stored) without notice and recover the goods.
This clause survives termination of the contract and is enforceable to the maximum extent permitted by law.
4. Delivery
Delivery costs are not included unless otherwise stated in writing.
While every effort will be made to deliver by the estimated date, Acacia Bakery Solutions will not be liable for penalties or damages (direct or indirect) resulting from delays caused by strikes, accidents, war, transport issues, or other events beyond our control.
Delivery applies only to
ground floor level, with no obstacles such as steps, multiple levels, or access limitations.
Delivery is during
normal business hours only.
5. Installation
Installation costs are not included unless stated otherwise in writing.
Installation includes positioning the equipment as directed by the buyer or their representative. It does not include connection of services (e.g. water, gas, electricity, drainage, or ducting) or removal of site waste.
All oven installations and commissioning must be carried out by an
approved Acacia Bakery Solutions Technician. Failure to comply will render the warranty invalid.
6. Warranty
New equipment is covered by the manufacturer’s
1-year parts and labour warranty, unless otherwise stated.
The warranty does not cover normal wear and tear items such as belts, switches, lamps, pump stators, seals, or glass.
The warranty does not cover damage caused by:
- Improper use or installation
- Incorrect storage
- Electrical, chemical, or mechanical stress
- Water, fire, or other misuse
The seller shall not be liable for loss of profits, special, indirect, or consequential damages arising from any warranty claim.
The buyer is responsible for ensuring that all safety regulations relating to the equipment are maintained and not interfered with.
